Dear Mr. Atto:
I am writing to introduce myself. As you know, I represent Jacklin Bejan
regarding the problems she is having with Fred Parhad.
First, let me say that Jackie, and I as her attorney, bear no personal
animosity toward you. Jackie is not interested in suing you for millions of
dollars. Nor does she wish to harm you or your reputation in any way.
However, as is stated in the lawsuit, we believe that your technical help is
absolutely critical in facilitating Fred's attacks on Jackie. Because of the
intricacies of defamation laws and jurisdictional issues, we had to put your
name in the lawsuit to ensure that the court in this matter can ultimately
control all those who may play any role in publishing Fred's defamatory
comments.
I also want to be perfectly clear. Ms. Bejan does not care in the least
about Fred Parhad's political speech or his work as an artist. He is free to
attack Christians, Jews, Muslims, rich people and any other generic group who
he chooses to get worked up about. He can make statues and sell them at
whatever price he feels the market will pay. What he cannot do is defame
Jacklin Bejan on the Internet. (Feel free to research and learn as much as
you wish about defamation, libel and slander - defamatory speech, which
covers much of what Fred says about Jackie - is NOT Constitutionally
protected.) The legal process is slow, but eventually Fred, and anyone who
helps him, will be held responsible for the content of what he has said.
Apparently the ISP that hosted Fredparhad.com agreed that Mr. Parhad's posts
violated their anti-obscenity / anti-defamation policies. Frankly, I am not
surprised. It seems Fred is the only one who doesn't understand you cannot
do what he has been doing on the Internet.
I do not speak for John Nimrod, Atour Golani or any of the many other
individuals who Fred has chosen to attack on publicly and by name on the
Internet. However, I will be very surprised if others choose to look the
other way after Fred has spewed so much legally actionable bile and abuse.
As for Ms. Bejan, I am quite sure that until Fred stops mis-using the false
power he gets from invading her privacy, making obscene personal attacks and
splashing her name across the Internet, there will not be peace.
You now face a choice. You can distance yourself from Fred and leave him to
fight his own battles and clean up the mess he has created. Or you can
continue to help Fred, having had it pointed out to you that, 1) Fred's
speech is defamatory and 2) Ms. Bejan and I will pursue through all legal
channels anyone who publicly libels or slanders her or helps anyone else
libel or slander her.
If you wish to resolve matters with me, feel free to contact me. If you do
retain an attorney, have him or her contact me immediately. It may well be
possible to work things out, either directly or through an attorney, so you
do not need to file an answer or appear in California court.
