Establishing the truth is the single most effective defense that can be
offered. If the remark is truthful and it "hurts", is embarrassing, or
subjects you to ridicule, there is little you can do. Unfortunately,
unless the remark is false, you have no recourse.
++++There isn't a thing I said about Jackie that was untrue. That she got her feelings hurt by my relating my opinion of the truth of what happened is just the way the world works. I was "hurt" too and embarrassed by her actions at the convention, in front of my wife and mother and uncle cousins and friends AND patrons and potential patrons....I was also hurt to see my sculptures collected into a corner and covered over as if they were ugly or offensive. But I wouldn't sue for that...I would sue for the actual damages done to me as a professional sculptor...for stopping me from selling at conventions when I've done it for over twenty years, for stopping me from getting buyers for a monument I had already sunk $90,000 into, and for lying about me being a troublemaker at Chicago...which I know she told the hotel people, though she was there and knows better.
+++Telling the truth, no matter how it bothers people, is not actionable. Shawn knows all of this, Jackie doesn't and she hasn't told him the whole story. He will run with this thing to the bank as far and as fast as he can. He will leave Jackie to deal with the mess after.
