But seriously folks...let's say I say "Get Fucked" to someone...say it on the internet. Is that obscene speech?
First of all, why is "fucking" obscene to begin with? I mean that's all anyone wants to do...so are we all engaged in obscenity? Wouldn't it be a NICE thing to wish someone "get fucked"?
If I call someone a "prick"...is that obscene? How can the male genital be obscene? I mean flashing it around downtown in considered obscene...but by itself the limp little fellow is hardly obscene...more like funny.
Am I being obscene, legally, if I write on the internet that so and so is a prick?
Jack Nicholson commented once that if you cut off a breast in a movie it's PG13...but if you kiss it, it has to be R...and if you kiss it a lot...X.
So what's obscene...kissing or cutting?
I never described any sex acts with anyone...ahem. Never undressed the person or talked about moles...wait, I think I did once. Never said I had sex with the person. Is it obscene to discuss those things in the abstract?
As far as I can tell, the legal definition of obscene dosen't cover what I am accused of.
I still say...if a guy is a prick...and you can prove it...you are merely guilty of having the bad taste to tell an unpleasant truth...is that actionable? Just pick better aquaintances in the future.
