...an interesting legal case over there...sort of a mini me of MidEast fandangles.

A popular bar owner and friend put their brass knuckles on and go out late one night near the bar the one guy owns. They encounter a white homeless guy...they tell him not to bed down for the night near there...words get hotter...the bar owner with the bras knuckles punches the homeless guy on the jaw..the guy gets pissed (probably has some Arab blood in him) grabs a pipe near by and whallops the bar owner and kills him dead.

The homeless man is arrested but the DA says it was self-defense and has the guy released. Bar patrons and family are enraged..they hand out free T shirts saying "Fuck the Homeless" and warn of vigilante action against the Homeless Terror..and a delegation goes to London to enlist the help of our dearest bar allies.

The family of the dead guy is seeking 5000 petitions to force a grand jury investigation..they think it was murder plain and simple..as if you're homelss, you might as well be Iraqi and anything done to you is your just desserts...and you even THINK about fighting back and you're a Terrorist and envious..you know the routine by now.

What's interesting is how the Constitution once again foils those who would use the Law as their own personal can opener..reserved for them whenever they feel picked upon. The DA says if a grand jury convenes, they're going to look into ALL the crimes committed that night..says already that under the law in Oklahoma, the homeless guy was clearly defending himself and who's to say how much force is enough when confronted by not one but TWO guys wearing brass knuckles late one lonely night..especially when one of them cracks you over the head with them.

The point being that a grand jury might just decide to bring charges against the other guy wearing the knuckles...but people in Tulsa are "fed up" with the homeless...as if they are pleased with themselves...the guy who fought back says that most of the homless he knows are mentally ill people we decided were bums and people with family problems...in other words, you and me down on our luck.

It seems in Tulsa the Law did the right thing...first off it isn't illegal to not have a home...sure the bar owner doesn't want people sleeping in doorways etc...but then people don't want to sleep there either and those are the only parts of town where rent is cheap enough for a guy to open a skid row bar...and where there is no one around at night to push homeless people along...except now the bar owners don't want them around either.

What's cute, in a sort of Republican way, is that the two guys claim they wear brass knuckles because of the heavy drug scene. I don't know when I heard of a dope dealer who doesn't carry a gun big enough to shoot your head off...no matter how many brass knuckles you have on...they also claim that they were chasing down a drug dealer when they ran into the homeless guy..that has a nice wholesome ring to it, that it's a lie as well can't spoil the pleasing effect...two citizens out patrolling the streets with brass knuckles making the empty hood a safer place for winos and bar owners.

The whole thing sounds a lot like Bush in Iraq. First they made a ghetto out of it..then they claimed they were chasing Terrorists and next that the brass knuckles they used were for self-defense cause it was a dangerous place to dig oil...or own a bar. They forget that they outnumbered the guy they hit first...that he had no intention of harming them, just wanted to get a night's sleep so he could make it through the next day.

Yet the citizens and family are outraged...why? Because the homeless man dared defend himself? Because he is homeless? Is that like being a Muslim..is it your faulty choice? They're warning of vigilante justice if the police don't "do their job"..which must mean they want the police to deal out vigilante justice and spare them having to do it.

By any sane measure, the police did their job already and did it well. They responded when called, found the homeless guy, arrested him, jailed him and turned it over to the DA who, as an elected official obeyed the laws of the land as he is sworn to do. The police didn't beat the guy up..they didn't shoot him in the course of an arrest..and the DA didn't throw the guy into solitary to "soften him up". That's the way America is supposed to work...we aren't Iraq after all...are we?

The DA looked at the facts, shoved aside emotional appeals, like he's supposed to...saw the brass knuckles, matched them up to the dents on the guys face...realized it was hardly likely a homeless guy started a fight with two solid citizens from a skid row bar each wearing brass knuckles...and some other things might have come to light that showed the two to go cruising the streets regularly trying to discourage the homeless from "Sleeping While Dark".

The only thing that saves this situation from resembling the war on Iraq is that the Law was upheld...it wasn't set aside for a pre-emptive strike on the homeless, not yet...but the citizens of Tulsa probably back Bush....so if nothing is done to send a message to the homeless that they best go elswhere...people are ready to take the law into their own hands...like their president showed them how to do when his bidness was at risk.

What goes around comes around..if people seriously think that the Law can be turned into a vehicle for carrying our their frustrations and emotional highballs..that it exists to serve THEM....the "good ones"...they open the day up when the wrong "good people" can use it against us all...that's what Hitler was able to do in Germany..or else he never could have trashed Germany the way no enemy ever did...as Bush is taking apart America...
