....great news...interesting times. Weīre still fighting the Civil War in America...weīre still arguing over Stateīs Rights verses the Federal Government...these are interesting times that test the validity of the idea of democracy, of majority rule. What if the majority want to re-instate slavery...or child-labor? If itīs a democracy why canīt they? If a majority of the people want something, isnīt that all it takes? Thankfully the Founders said "NO"....you can have a democracy of brutes, of cannibals, of Christians...and each can pass laws favoring themselves and against all minorities. For a democracy to be worth a damn and not merely be a tyranny of the majority, you have got to build in protections for the minorities...especially if you want to avoid armed conflict. You have to create a higher standard than mere popularity...thatīs why our Constitution has judicial review before any law, even a very popular one, goes into effect. There is no reason, in Reason, why Gays cannot marry. It is merely a religious superstition and cultural bias...and laws cannot be built on that basis...once the anti-Gay people had to actually explain themselves to grown-ups in a place where both sides had to be heard, they failed utterly to be convincing. It is only on FOX and the rest of the privately-owned media that these people APPEAR to make sense...because the owners are careful to not include anyone who can tear them apart...this is how Dadeeshoo and OīReiley and all the others manage to appear slightly sane and rational; because they are carefully shielded from any real confrontation or intellectual challenge...but in court, away from Sarah Palin, their true colors appear...they are nothing more than people demanding discrimination against those they donīt happen to like...nothing more. The issue now goes to the Supreme Court...and no matter how conservative the justices, it should be interesting to watch how they rationalize making discrimination a part of the law of the land...if they do. The mosque in Manhattan is another interesting case pitting demoicracy against human decency and fairness.....58% of the PEOPLE poled in New York do not want the mosque so close to ground zero...should the will of the poeople prevail? The Constituion says ONLY when their will is in conformity with the Constitution....and unless they can change the Constitution, legally as provided, then being in the majority means nothing if the majority goes against the Constitution. There is no legally viable reason why the mosque canīt be built anywhere in New York. Weīve had decades now when religion has been shoved down our throats...where we even now fund religious madrassas with federal dollars...we are creating a majority of irrational people who believe they are on Godīs side and who are opposed to anything that smacks of Humanism...of a !Live and let Live" attitude...intolerant people who insist that not their narrow prejudices and ill-concealed racism is at play but rather a "higher calling" in the service of their god...so fuck the rest of us pagans who donīt agree with them. Just because 51% of the people want to revert to cannibalism doesnīt mean 49% have to go along. Or that the will of the majority must prevail.
