...Kennedy must be mightily pissed at Gay marriage equality...also proves my point that religion makes otherwise sane people stupid. It's a shame that I have to teach this judge about our Constitution, but it has to be done. This is what he wrote in dissent when DOMA was cancelled....and by the way these guys are all religious...their take on this is all about religion and about how we're supposed to get our moral teachings from THAT book. "What the court fails to grasp or accept is the basic premise of the initiative process. And it is this. The essence of democracy is that the right to make law rests in the people and flows to the government, not the other way around. Freedom resides first in the people without need of a grant from government," he wrote. "The California initiative process embodies these principles and has done so for over a century. ... In California and the 26 other states that permit initiatives and popular referendums, the people have exercised their own inherent sovereign right to govern themselves. The court today frustrates that choice." ...what Kennedy fails to grasp is that we have a Supreme Court because the people did exactly what he says...when the people voted to ratify the US Constitution they knew that a part of it dealt with the judiciary and the question of how we are to know that any new law obeys the Constitution...so the PEOPLE, way back then, decided that any new law, or old law for that matter, MUST be interpreted by the Supremes in order to make sure it conforms with our guiding principles, BEFORE it can become law...doesn't matter how popular that alw is, it can't BE law until the Supreme Court says so...you'd think, being part of that court, the old fool would know that and wouldn't instead be saying that the PEOPLE are the final deciders....that is the JOB of the Supreme Court and it is something the people AGREED to...long ago. It was NEVER the law of the land, or practice, that states or cities or the federal government could pass whatever law they liked and if the people LIKED it, it became law automatically...Kennedy is letting his religious outrage get the better of his head...surely he KNOWS this, but religion makes him go "arfle farfle" too. There is no LEGAL or Constitutional basis at all to deny gays equal right...FULL equal rights not "skim milk" marriages but exactly what every American gets...regardless of sexual orientation OR race OR gender...period! --------------------- |
