CAN I SUE SOMEONE WHO SAYS OR WRITES SOMETHING DEFAMATORY ABOUT ME?
[Free legal information for libel/slander law @ FreeAdvice.com.] In
order to prove defamation, you have to be able to prove that what was
said or written about you was false. If the information is true, or if
you consented to publication of the material, you will not have a case.
++++Again, the key is..."is the information true"? She is suing ME...she has to prove what I said is false. How do you do that? I can back up everything I claimed...about the Arts Commission, about the contract being her idea and her's alone...about the quick turnaround she made when I said "no" to her...about her having my sculpture all over her house and so when did I become a "troublemaker"? I can even show that she KNEW I was no troublemaker and on and on.
However, you may bring an defamatory action if the comments are so
reprehensible and false that they effect your reputation in the
community or cast aspersions on you.
+++++I cast no aspersions on her at all. What I said was true. Has she really suffered in her reputation? I mean in such a way that has harmed her in more ways than she claims...in ways a jury can see evidence of? I think not.
